The SADC of Nicolet-Bécancour inc. (hereinafter referred to as “SADC”) collects personal information during your interactions with an authorized representative of the SADC and through its website https://www.sadcnicoletbecancour.ca (hereinafter referred to as the “Website”).
Personal information is collected by various means:

Communications of personal information
The SADC communicates personal information:
- To its employees if they need access to this information in the course of their duties;
- To any other person or entity, when communication is required or permitted by applicable legislation without the consent of the individual concerned, or with the consent of the individual concerned; and
- To external service providers with whom the SADC has entered into a contractual agreement under which the external service provider may not use the personal information for any purpose other than providing the said service and must destroy the personal information communicated no later than the end of the contractual agreement;
- To any association in which the SADC is a stakeholder;
- To any ministry, government agency, and level of government with which the SADC has entered into a service agreement.
Consents
If you continue to use the SADC Website, if you provide this information to an authorized representative of the SADC, or if you communicate personal information to the SADC by filling out a form provided by the SADC, you consent to the purposes and communications of the personal information mentioned below and above.

The present Policy records the measures and practices that the SADC of Nicolet-Bécancour inc. (hereinafter referred to as “SADC”) has implemented to govern its management of personal information and to protect personal information. The SADC collects personal information from its clients, visitors to its Website, or individuals applying for a job with the SADC (hereinafter referred to as “you”, “your”, or “yours”). In this Policy, the term “personal information” refers to any information collected by the SADC that allows, alone or in conjunction with other information, to directly or indirectly identify any individual concerned by the personal information.
The main purpose of this Policy is to inform you:

- Of the nature of the personal information collected by the SADC and the purposes pursued by this personal information;
- Of how the SADC may use the personal information as well as the third parties to whom the SADC may communicate this personal information, if applicable;

By transmitting one or more personal information to the SADC through (i) direct or indirect contact with an authorized representative of the SADC or (ii) your use of the Website, you expressly consent to the SADC collecting, using, communicating, and retaining this personal information in accordance with the terms, conditions, and provisions set forth in this Policy.
The present Policy and any modified version thereof are subject to the applicable legislation in the province of Quebec in Canada.
1. Under what circumstances does the SADC collect personal information, by what means, and for what purposes?
The SADC collects personal information in two circumstances: (i) when voluntarily transmitting personal information to an authorized representative of the SADC and (ii) when you use the Website.
i) Voluntary transmission of personal information to an authorized representative of the SADC
What are the means of collection
The voluntary transmission of personal information to an authorized representative of the SADC can be done by various means including:
a. By voluntarily answering questions from SADC agents who may communicate directly with you by phone, in person, by mail, or by electronic mail;
b. By providing personal information to SADC agents by phone, in person, by postal mail, or by electronic mail;
c. By providing information to SADC agents electronically, by phone, or in person during job interviews.
What personal information does the SADC collect through its authorized representatives?
In the aforementioned circumstances, the SADC may collect the following personal information:
- The name, first name, preferred language, and some of your contact details (phone number, email address…);
- In the context of a job application, information related to your level of education or training (year of graduation, information related to primary, secondary, college, or university studies…);
- In the context of a job application, criminal records;
- In the context of a job application, the position sought (whether the position sought is regular, part-time, or a student job);
- In the context of a job application, your previous jobs and work experience;
- Financial information when necessary to complete a transaction that the individual concerned by the personal information wishes; or
- In the context of a job application, personal information provided on your resume that we would need to collect to evaluate an application.
In all cases, before collecting personal information about you, the authorized representative of the SADC will specify the personal information requested before collecting it.
What are the purposes of the personal information collected by the agents of the SADC?
The SADC collects personal information through its agents for the accomplishment of numerous purposes:
- To communicate with job applicants or potential clients and ensure that the communication regarding them is personalized;
- To advertise to clients, visitors, or potential job applicants;
- To evaluate the job applications;
- To respond to your requests;
- To assess your needs and interests;
- To ensure compliance with a law, a court order, or a legal proceeding;
- To ensure the legal protection of the SADC in case of litigation;
- To assess and improve protection and security measures;
- To prevent or detect fraud or illegal acts; and
- To respond to complaints and requests for access, correction, or withdrawal of consent.
ii) Collection of personal information during your use of the Website.
What are the means of collection
When you visit our Website, personal information is collected about you by various means, namely:
- Automatically through your connection to the Website (your computer and the Website server automatically exchange personal information during the connection);
- Automatically through the installation of temporary connection cookies on your computer and through the use of pixels;
- Automatically through our logging processes;
- Through your email communications (if you provide us with personal information via emails); and
- Through the information you enter in our forms available on our Website.
What personal information does the SADC collect?
The SADC may collect the following personal information:

- Your browser (Explorer, Firefox, etc.);
- The operating system (Windows, Mac OS, etc.) you are using;
- The date and time of your visit to the Website;

- The address of the referring site, if you access the Website from another site.
b. Other information collected:
If you send us an email, make a request, or communicate directly with us via chat, you may provide us with other personal information whose content will vary depending on the nature of the exchanges.
Please note that the personal information recorded in your exchanges and your communication history with the SADC will be collected.
Finally, any request for access, correction, or withdrawal of consent according to the provisions set forth in section 7 of this Policy will require you to prove your identity by providing us with a valid photo ID and your name. All other personal information contained in this ID may be masked.
For what purposes does the SADC collect personal information?
The SADC collects your personal information for the following purposes:
- To ensure that a visitor to the Website can log in to the Website;
- To ensure that the Website can function properly;
- To evaluate the effectiveness of the SADC's efforts to attract visitors, clientele, or candidates;
- To improve the performance of the Website and its effectiveness in retaining visitors;
- To identify the legislative framework to which the personal information of visitors is subject;
- To communicate with job applicants or potential clients and ensure that the communication regarding them is personalized;

- To assess and improve protection and security measures;
- To prevent or detect fraud; and
- To satisfy complaints, requests for access, correction, or withdrawal of consent.
Links to other sites
The Website sometimes provides links to other websites belonging to other organizations. When you visit these sites, you will not be subject to this privacy policy, but to that of the external site, if it has one.
2. To whom is the SADC likely to communicate your personal information?
In general, the SADC uses your personal information only for internal purposes.
However, the SADC is likely to communicate, transmit, or allow access to your personal information to the following persons or entities:
a. To the employees of the SADC if they need access to this information in the course of their duties;
b. To any other person or entity, when prescribed or permitted by applicable legislation;
c. To any other person or entity to whom you consent to the communication of the information;
or
d. To external service providers with whom the SADC has entered into a contractual agreement under which the external service provider may not use the personal information for any purpose other than providing the said service and must destroy the personal information communicated upon termination of the contractual agreement.
The SADC may communicate your personal information to persons or entities belonging to the categories listed above that are located outside the borders of the province of Quebec.
3. Limits on the communication and use of personal information
The personal information collected is destroyed as soon as the purposes for which it was collected are accomplished unless, of course, a law or regulation requires the SADC to retain it or a law or regulation imposes a specific retention period.
The SADC does not sell personal information to third parties and does not allow third parties to access personal information unless granting such access is necessary to fulfill one of the aforementioned purposes and that access or communication without the consent of the individuals concerned is authorized or imposed by a law or regulation.
All privacy settings applicable to your use of the Website offer, by default, the highest level of privacy, without any intervention on your part.
4. How does the SADC protect the confidentiality of your personal information?
The SADC takes adequate physical, technological, contractual, and administrative protection measures to protect your personal information and reduce the risks of unauthorized access, use, communication, and destruction.
Without limiting the generality of the foregoing, the Website is equipped with certain security mechanisms aimed at protecting your personal information, namely:
- The personal information collected on the Website is encrypted at rest;
- All transfers of personal information between the different components of the Website are encrypted; and
- The IT service providers of the SADC are contractually required to comply with various security obligations which include periodic validation of security practices and processes as well as continuous monitoring of the software components of the Website and their updates.
In addition to these measures, the SADC also provides, among other things:
- An internal access management policy for its employees. According to this policy, only our employees who need to access personal information to perform their duties may do so;
- An internal personal information protection policy to which SADC employees are subject to ensure the integrity, availability, and confidentiality of personal information;
- A confidentiality incident log, which helps the SADC inventory incidents, minor or major, that affect your personal information to ensure that these incidents do not recur and to identify necessary measures;
- A personal information retention schedule, to ensure that personal information is destroyed when it is no longer required for the aforementioned purposes and that the law no longer requires its retention;
- A confidentiality incident response plan, which allows the SADC to respond effectively and quickly to breaches of your personal information;
- Logging of access to your personal information; and
- Annual training for our staff members.
Despite these various measures, it remains impossible for the SADC to guarantee the security of the personal information entrusted to it. 5. What measures has the SADC put in place regarding confidentiality incidents?
The SADC maintains a confidentiality incident log in accordance with applicable legislation. In the event of a breach of your personal information presenting a risk of serious harm to you, the SADC will take the necessary measures to notify you, in accordance with applicable legislation. The SADC will also implement measures to limit the harm that may result from the breach and to limit the chances of the breach recurring.
6. What is the retention period for your personal information?
In accordance with our secure retention and destruction procedures for personal information, we only retain your personal information for the duration necessary to fulfill the purposes listed in section 1 of this Policy or for the duration required to comply with our statutory obligations, according to the later of these deadlines.
7. Requests regarding personal information
i) Access request
You or a person authorized by the Private Sector Privacy Act may make a request for access to your personal information by directly contacting our Personal Information Protection Officer according to the procedure mentioned below. The Personal Information Protection Officer of the SADC will grant this access unless:
- The law prevents the SADC from granting access;
- The SADC has a serious and legitimate interest in refusing access; or
- Granting this access risks seriously harming a third party.
In principle, exercising the right of access is free. However, reasonable fees may be charged to the requester to cover the costs of transcription, reproduction, or transmission of personal information. In such a case, the requester will be informed of the amount of the fees in question before processing their request.
You may also request to obtain a copy of the personal information concerning you by submitting a written request to the Personal Information Protection Officer according to the procedure mentioned below.
In the event that the SADC agrees to any request for a copy of computerized personal information made, the SADC will ensure to communicate (or to any person or organization authorized by law to collect such personal information) this copy in a structured and commonly used technological format. Unless the communication of this copy in such a technological format raises serious practical difficulties or the SADC or one of its service providers has inferred or created the personal information.
ii) Correction request
We ask you to inform us of any changes that may affect the authenticity or accuracy of your personal information.
You or a person authorized by the Private Sector Privacy Act may also submit a request for correction of your personal information. Such a request will allow you to correct the personal information in our possession if:
- The personal information is inaccurate;
- The personal information is outdated;
- The personal information is ambiguous;
- The personal information is incomplete; or
- The personal information has been collected unjustifiably.
Alternatively, you may submit a written request for correction asking our Officer to destroy outdated personal information or information collected or retained unjustifiably. Any request for destruction or correction must be addressed in writing to our Personal Information Protection Officer according to the procedure mentioned below.
iii) Request for cessation of dissemination, de-indexing, or re-indexing
The SADC may also, at the request of the individual concerned by the information or any person authorized by law to act in this way, cease the dissemination of personal information, de-index, or re-index, as the case may be, any hyperlink attached to the name of a person concerned by personal information, subject to the criteria established by the applicable legislation in force at that time.
iv) Request for withdrawal of consent
Subject to your contractual commitments with the SADC and applicable legislation, the Private Sector Privacy Act (if it applies to you) allows you to withdraw your consent to certain uses or communications of personal information. Please note that exercising this right may affect the services of the SADC regarding you. In this regard, if you make this request, the SADC will identify what the consequences of the withdrawal of consent will be on the services.
8. Request procedures
All requests for access or correction must be addressed in writing to Carolyne Aubin, our Personal Information Protection Officer. A requester may contact her directly by sending an email to caraubin@sadcnicoletbecancour.ca.
The request must be sufficiently detailed to allow our Officer to assess and locate the personal information targeted by the request. Above all, the requester must ensure that the Officer can reach them so that the Officer can assist them in clarifying their request, facilitate the identification of the personal information targeted by the request, and, above all, communicate the acceptance or refusal of their request if applicable.
The Personal Information Protection Officer has the duty to process these requests within 30 days. If the request is not processed within the time limits, it is deemed to have been refused.
9. Complaint procedure
You may file a complaint regarding our methods, practices, and policies for protecting or governing personal information by directly contacting our Personal Information Protection Officer at caraubin@sadcnicoletbecancour.ca.
The Personal Information Protection Officer will respond to the complaint within 30 days of its receipt. If the complaint is accepted, a brief summary of the changes made to our methods, practices, and policies for protecting or governing personal information will be provided to you.
10. Changes to the privacy policy
The SADC may unilaterally modify this personal information protection policy. However, before implementing changes, the SADC will communicate a notice on the Website identifying the upcoming changes. We therefore invite you to revisit this policy from time to time and check if it has been modified. To facilitate this process, we have recorded the date of the last update of this Policy.
If you have provided us with your email address, you will also receive this notice or a similar notice by email. Your use of the Website, your communication of your personal information to an authorized agent of the SADC, or the submission of your personal information on a SADC form from the receipt of this version will be deemed to constitute acceptance of the changes made.
